Grammar ain't all that | Life of an Architect

For those of you who have been through Life of an Architect before, you will know that I take a lot of liberties with my ?grammar?. That?s right, I am a bad boy when it comes to following some of the rules but at this point ? some 350+ posts later ? that cat?s been let out the bag and I don?t really care. That?s because I have developed a writing style that I like to call ?I type it just like I thought it out in my head? [yeah ... that's a bad-ass title]

? I?m not writing a technical manual here ? I am trying to get you to read what I am ?saying.?

Since I get some grammar police on my back from time to time, I need you busybody people to understand that I think faster than I type and when I make a mistake, it?s on purpose. Well? sort of. For the record, I always spell check so it isn?t too often that I misspell a word. I might use the wrong word but that mo-fo will be spelled correctly.

(did you notice how I used the right version of ?too? instead of ?to?? I get that right sometimes?)

So yes, my writing style is a written version of my talking style minus the wild arm gesticulations and the appropriate regional dialect. I scatter commas into my?sentences?like buckshot ? but I?m not writing a technical manual here ? I am trying to get you to read what I am ?saying.? It?s not as easy as it looks.

When is the right time to add a dot dot dot? Hmmmm ? I wonder?

How about dealing with a sentence that goes on and on and on ? maybe a dash would fit the bill? Sometimes I use dashes when I want the reader to ?hear? what I wrote as if I was speaking under my breath. As it turns out, there are loads of examples of speaking under my breath in. this. very. post!

How do you convey a conversation with yourself or show what you are thinking? (because in my blog world, that?s important)

Bob: I wonder if this post will make any sense?

Inner Bob (who also happens to be much better looking):?Your readers are super smart, I?m sure they?ll understand.

Bob: I don?t know. I?m not all that sure that I understand. You know I?m making this up as I go right?

Inner Bob:?Of course I do, who do you think is actually coming up with all this stuff in the first place?

Bob: think they know that I use italics whenever I am thinking inside my head?

Inner Bob: They do now ?

I could go on for a while but I think the idea of my post is established now. I am sure there are rules for all the things I do in an effort to convey the conversational tones of my blog posts. While I don?t know if you literally get it, I do know that people recognize that there is a purposeful style to how I write.

Wow ? okay. For the record, I almost barfed when I wrote that I ?write? because I don?t write. I speak and then I type (or more specifically I think and then I type, and clearly I don?t think all that much before I type).?

I read a post on the Harvard Business Review titled ?I Won?t Hire People Who Use Poor Grammar. Here?s Why? and I thought ?Oh my Gawd, I could never work for that guy because my grammar sucks?. Don?t worry about?why I was reading the Harvard Business Journal and don?t worry about the fact that I wouldn?t want to work for that guy anyway. The point is that I write a bunch of garbage (re: this post in particular) and stick it out there for anybody to read knowing that there are most likely grammar mistakes. I also know that it is easy to judge somebody by the quality of their writing (I do it) ? I?m just not sure my sort of ?writing? qualifies as actual ?writing.

There is something inherent about a blog that implies spur of the moment stream of consciousness sort of sharing. I don?t agonize over how the content is delivered or whether or not how I write is as important as the message I am trying to convey. Of course, if the message is lost because the grammar is so terrible that the posts are agonizing to read ? that?s a different story ? err, conversation.

How about proof-reading? Sure, of course I proof read, but since the time span from when I wrote it to when I am proof-reading it is typically nothing, my brain fixes the errors internally when I am reading what I just wrote. If you write I think you?ll understand what I just said. After a few hours of sleep, I almost always find a few things I would like to change when I go back and read what I wrote. Unfortunately I am not programmed to work like that. I get an idea or an itch to talk about something and it just pours out of my head ? as soon as I take out the trash and clean the litter box. I try to type as fast as I can to keep up and then hit the ?publish button?. Maybe not the smartest thing to do but with the exception of a handful of people who feel the need to publicly correct a typo or grammar error -?which is a total jerk move by the way. Besides, I?ll go back and fix it and when people read the comment you left pointing out a mistake that doesn?t exist anymore guess who looks like the dolt? Most people I don?t think care too strongly one way or the other. Typos and grammar issues in blogs such as mine don?t bother me as much as articles that I read in magazines, newspapers ? anywhere an article is written for pay or isn?t on a blog.

Maybe it?s a characteristic of architects to always have a ?work in progress? view towards things?

Or maybe I?m on an island here ?

Windows Phone 8 SDK leaks show quiet upgrades to backup, media and the kitchen sink

Windows Phone 8 SDK leak shows us big backup, browser and Xbox revamps

The Windows Phone 8 SDK has escaped to the wild, and some sifting through the device emulator has dug up elements that Microsoft either skipped or only touched on lightly during the big unveiling in June. The most important addition may be the one customers see the least: backup. A WP7.hu search has the new OS replicating apps, settings and SMS messages in the cloud to prevent disaster, and that new SD card support will let WP8 owners shuffle photos from internal storage to the removable kind for safekeeping. There's also more work on Internet Explorer than we saw before, with MobileTechWorld noticing that DataSense provides an option for Opera-like remote compression to save that precious cellular bandwidth.

Media fans might have the most to gain. If we go by The Verge, both the Music/Video and Xbox hubs are getting fresh coats of paint -- both to integrate new ventures like Xbox Music as well as to jive more closely with the SmartGlass visual theme. Shutterbugs will like the long-awaited options to crop and rotate their work, pick multiple photos, and unify third-party camera apps under a Lenses concept. There's even more clever features in store, such as a Maps update that finds nearby WiFi hotspots, so head on over to the sources to get a full sense of where Microsoft will be going.

CNN chief Jim Walton calls it quits

NEW YORK (AP) ? CNN chief Jim Walton said Friday he is quitting, saying the company needs new leadership at a time its flagship U.S. network is suffering through some of its poorest ratings ever.

Walton built the company into a profitable international news organization in his 10 years as president of CNN Worldwide, and said it is on track for record profits this year. But the U.S. network is the most visible part of the business and is now entrenched in third place behind rivals Fox News Channel and MSNBC in prime time.

He announced the decision in an email to staff members on Friday. He said he'll continue working until the end of the year during the company's search for a successor.

Walton said he's been talking to his boss, Turner Broadcasting Chairman Phil Kent, about leaving since the first few months of the year. CNN is owned by Time Warner.

"There's always pressure," he said. "I've been doing this a long time and CNN has had its ups and downs, like all companies have had ups and downs. I feel really strongly about a number of parts of this company. We're having a really strong year internationally and in mobile. It's clear there's a lot of spotlight on CNN's U.S. performance and it's reasonable that there is that spotlight."

CNN's U.S. network had its worst-ever ratings for a second quarter, down 40 percent for some of its prime-time shows. The decline was particularly notable in May, when CNN faced tough competition from broadcast networks during a slow news period and its ratings were compared to a year earlier, in the aftermath of the Osama bin Laden killing.

It hasn't improved appreciably since then, with veteran newsman Wolf Blitzer often losing in the ratings to broadcast novice Al Sharpton on MSNBC. Piers Morgan's show has been a bright spot this month.

The network was also embarrassed by initially reporting incorrectly the U.S. Supreme Court's decision on President Obama's health care law, then taking longer to correct itself than Fox, which made a similar error.

CNN's ratings traditionally fluctuate based on the intensity of the news. Fox and MSNBC have insulated themselves from that problem somewhat through its partisan prime-time hosts. Walton has resisted this approach, believing CNN's strength lies in being a nonpartisan news source and the company's reputation would be damaged worldwide if the U.S. network changed.

Walton said he doesn't expect that to change after he leaves.

"We kind of know who we are and our corporate colleagues know who we are and there has always been great support internally that we're going to be a news organization," he said.

At CNN, "we want to be accurate above all else, we want to be timely ? first if possible ? we want to actually go to where the news is, not just subscribe to some agency's news feed and talk about it. We want to report the news from multiple sides, all sides, and without bias."

Walton, 54, began working at CNN in 1981 shortly after it started. His first job involved ripping paper scripts off wire machines and operating the TelePrompter for news anchors.

Jeff Bewkes, Time Warner chairman and CEO, said Walton took over an underperforming company in 2003 and tripled earnings, delivering an annual growth of 15 percent. Roughly half of the company's earnings come through subscription fees from cable and satellite companies, and they have been growing steadily worldwide.

"Jim has been instrumental in growing the business into the financial powerhouse it has become, while establishing the brand as the worldwide leader for television news," Bewkes said. "I respect him personally and professionally and support the decision he and Phil Kent have reached."

Kent said Walton has a track record of great judgment when it matters most. He "challenged the organization to think bigger, reach further, do better," he said.

"I think this company needs some new thinking," Walton said. "I've been doing this job I'm in now for 10 years and I'm ready for a change."

Gene fusion is behind deadly brain cancer

Treatment for a lethal form of brain cancer could be on the horizon after the discovery that the cancer can be formed by two genes fusing together. People with the disease could potentially benefit from drugs that block the activity of a protein produced by this wayward fusion.

Cancers can be sparked by a number of genetic mutations, including disruptions to single parts of a gene that either over-stimulate or castrate an important protein. But some cancers arise when two entire genes are accidently fused together during natural cell replication. The protein that the fused genes code for performs some of the functions you would expect of it but does so in new locations or contexts. "They do their thing, but incorrectly," says Anna Lasorella at the Institute for Cancer Genetics at Columbia University, New York.

Lasorella and her colleagues studied the genes involved in a lethal form of brain cancer called glioblastoma. About 3 per cent of the glioblastoma tumours they looked at were caused by the fusing of two genes.

On its own, each gene has an important but benign function. When fused together the two wreak havoc during cell division. The protein that the fused genes code for latches onto the spindles that pull freshly replicated chromosomes into two new cells during cell division. The interference means that instead of an even division, the cells end up with different numbers of chromosomes: a phenomenon known as aneuploidy. "It's a well-known hallmark of cancer," says Antonio Iavarone, also at Columbia.

Having identified this mechanism, the team wanted to check that the fused genes actually cause this form of cancer. So they injected the newly formed protein into the brains of healthy mice. Ninety per cent of the mice went on to develop the expected glioblastomas.

The team then administered a drug that blocked the activity of the new protein. In doing so, they were able to double the mice's survival time.

Because the protein is specific to the cancer cells, the team predicts that drugs to target it would cause minimal damage to healthy cells.

US confirms defections of two more Syrian envoys

The United States on Wednesday confirmed the defections of two more senior Syrian diplomats, describing this as further evidence that President Bashar al-Assad's days are "numbered."

"We can confirm the defections of Syrian ambassadors to both the UAE and Cyprus," White House spokesman Jay Carney told reporters aboard Air Force One. Earlier, sources had told AFP the two envoys had defected from the regime.

Carney said the move showed that "senior officials around the Assad inner circle are fleeing the government because of the heinous actions taken by Assad against his own people, and the recognition that Assad's days are numbered."

Earlier, a high-level source told AFP on condition of anonymity that Syria's charge d'affaires in Cyprus, Lamia Hariri, has defected from the regime.

An opposition activist in the country confirmed that Hariri's husband, Syria's ambassador to the United Arab Emirates, Abdel Latif al-Dabbagh, had also defected.

Qatar-based Al-Jazeera television said on Wednesday that Dabbagh had defected, though it did not say where he was.

But a senior State Department official confirmed to AFP that "Dabbagh has defected to Qatar and has joined the growing number of Syrians who are doing what is right for the Syrian people."

"These defections serve as a reminder that the bottom is starting to fall out of the regime. It is crumbling and losing its grip on power," the official added, asking to remain anonymous.

The string of defections come after Nawaf Fares, Syria's ambassador to Iraq, left for Qatar this month after publicly renouncing his post.

Being Healthy Is Not Going To Take As Much Time As Men And ...

By Laura Gregory

An excuse is something that men and women come up with as a reason to avoid something. From time to time these so called excuses may actually be a real reason, but primarily it is just men and women trying hard not to do something. This is especially true in the area of health and fitness and this is despite the fact that we know a healthier lifestyle is good for us. Even though many men and women are actually busy they?ll use this as an excuse to let there health and physical fitness suffer. This to some degree comes down to your determination but if you genuinely want to feel more healthy, here are several tips to help you find the time.

In some ways, just about the most important steps you can take in committing to get fit is actually preparation. More than likely in your everyday life you have had to prepare for something even if it is only for a meeting at work. It is possible to take this preparation and carry it over to your health and fitness plans. You need to find out when you have around 30 minutes or even an hour, and be sure to set this time aside so you can get some type of exercise. For people who choose to hit the gym after work you should actually visit the gym on your way home as opposed to having to go back out again as soon as you get home.

Your eating plan is an additional thing you will probably have to prepare for if you plan on eating much healthier. You should have a good breakfast before you go out and you can also take some healthy snacks with you. I know at one point or another you stopped by the store to get something quick to eat to hold you over to your next meal, like a candy bar. In the event you planned out your snack foods you could have had an apple which is of course better for you and also may keep you feeling much less hungry for an extended amount of time. See if you can get someone to exercise with you as you may well be more apt to keep it going when there is somebody else doing it too. How long you exercise could possibly increase when your working out with a buddy.

And you should not use the excuse that you have to travel for your profession. It might be that you stay in different places every once in awhile in which case, you can do some research just before your trip to see where you may be able exercise when you are away. And when your making your reservation for your hotel ask them about their exercise facilities and the hours it is available. If this is not a choice for you, there is a wide choice of fitness machines available now that are made to be portable. By doing this it is possible to still get your workouts in and you will in addition have a good way to help you pass the time when your stuck in the room for a long time.

Needless to say when all else fails remember that you have the entire Internet which can help you find great diet and exercise programs. If your serious about this you?ll find the time, regardless of how hectic your life is the time to become fit and healthy can be found.

Police: Cal Ripken's mom abducted, now safe

ABERDEEN, Md. (AP) ? Cal Ripken Jr.'s 74-year-old mother was found with her hands bound in the back seat of her car Wednesday after she said she was kidnapped at gunpoint a day earlier at her home outside Baltimore and driven around blindfolded by her abductor, police and neighbors said.

Investigators do not know the kidnapper's motive and there was no ransom demand for Vi Ripken's release, Aberdeen Police Chief Henry Trabert said at a news conference.

The gunman forced Ripken into her silver Lincoln Continental between 7 a.m. and 8 a.m. Tuesday, police said. She was found bound and unharmed but shaken about 6:15 a.m. Wednesday near her home in Aberdeen, about 30 miles northeast of Baltimore.

When asked if police believe the kidnapper knew who he was abducting, Trabert did not answer, saying investigators don't know the motive or if the suspect has any ties to the Ripken family.

A next-door neighbor said Vi Ripken told him her kidnapper didn't seem to know that her son was the Hall of Fame infielder nicknamed "Iron Man" for playing in 2,632 consecutive games during his 21-year career with the Baltimore.

Gus Kowalewski said he spoke with Vi Ripken later Wednesday morning and she told him the gunman tied her hands and put a blindfold on her, but said he wouldn't hurt her.

"He lit cigarettes for her, they stopped for food," Kowalewski said. "He said, 'I'm not going to hurt you. I'm going to take you back,' and that's what he did."

Kowalewski said Ripken told him the gunman originally planned to put tape over her eyes.

"But he didn't do that because she said 'please don't do that 'cause I'm claustrophobic,'" said Kowalewski, a 72-year-old retired autoworker.

Instead, the gunman put some type of mask or blinders on her, and she could see somewhat out the sides, he said.

Ripken told her neighbor the gunman also didn't seem to know she was part of the Ripken family, who is well-known throughout the Baltimore area and to baseball fans all over.

"He said he just wanted money and her car," Kowalewski said.

Three years after voluntarily ending his Iron Man streak, Ripken Jr. retired in 2001. He is the chairman and founder of Ripken Baseball Inc., which he runs along with his brother, Bill.

He owns three minor-league baseball teams, including the Single A IronBirds based at the Ripken Baseball complex in Aberdeen, a middle-class area of about 15,000 people. Kowalewski said Ripken told him the gunman asked her about items in the car related to the Ironbirds and did not seem to know about the team.

Mike Hudson, 43, whose mother lives across the street from Ripken, said he was surprised the kidnapper came back to the neighborhood because police were swarming over the area about midnight.

"It's just hard to believe the guy came all the way back on the street and dropped her off. That makes me believe he was local, very local," said Hudson, who is staying at his mother's house while visiting with his daughter.

"I came out again at like five something, and all that scene was gone, I remember that. When I came out at eight, it was all crazy again with helicopters going over and I saw the car right away," Hudson said.

Ripken's car didn't appear to be damaged, he said.

"This has been a very trying time for our family, but we are grateful and relieved that mom is back with us, safe and healthy," the Ripken family said in a statement. "We want to thank everyone for their tremendous support, especially all of the law enforcement agencies that worked so hard and quickly."

Investigators determined that Ripken was missing Tuesday night after talking to Baltimore County Police, who notified the media about her disappearance shortly before she was found. The county borders the one where Aberdeen is located.

Aberdeen authorities have asked Baltimore County Police not to release its 911 tapes because the investigation is continuing. Police also would not say whether Ripken's credit or ATM cards had been used.

Vi Ripken described her abductor as a tall, thin white man with glasses wearing camouflage clothing, but police had no other details. The FBI and Maryland State Police were also involved in the investigation.

Ripken's brother, Bill, played second base in the major leagues. The two were managed for a time on the Orioles by their father and Vi's husband, Cal Ripken Sr., who died in 1999.

The family said that it could not comment further due to the ongoing investigation.

After the gunman left, Ripken honked her car's horn until a neighbor found her, Kowalewski said. He said he was surprised the honking didn't wake him up. Someone reported a suspicious car to authorities and she was found, police said.

Vi Ripken is founding chairwoman of the Cal Ripken Sr. Foundation, which, according to its website, helps to build character for disadvantaged young people. Besides Cal and Bill, she has another son and a daughter.

The Ripken Baseball complex also is home to the annual Cal Ripken World Series for 11- and 12-year-olds. Cal Ripken Baseball is the name for the 5-to-12-year-old division of the Babe Ruth League.

Ripken's business empire also includes youth baseball camps and clinics, a minor-league stadium design firm, a merchandising arm and a charitable foundation. Ripken has no formal role with the Orioles but has spoken about his desire to return to the team.

Ripken works as a studio analyst for TBS during its postseason baseball coverage. He is a pitchman for brands including Energizer, Under Armour and Chevrolet.

Plains ranchers sell cattle as US drought spreads

Chart shows the decline in the U.S. cattle inventory since 1990.

(AP) ? Kansas cattleman Ken Grecian sold 20 pairs of cows and calves a few weeks after drought had sucked his pastures dry and no rain was in the forecast. He sold 20 more pairs Friday.

Grecian spent years meticulously breeding his cows to improve the genetics in each generation, but with Kansas in one of the worst droughts seen in decades, he's struggling to find enough grazing to feed 300 cows, plus their calves. He hopes to get by with selling only a quarter of his herd, but there are no guarantees with the drought expected to linger through October.

Other cattlemen throughout the middle and western part of the U.S. also are selling animals they can't graze or afford to buy feed for. Beef from the animals now flooding livestock auctions will start showing up in grocery stores in November and December, temporarily driving down meat prices. But then prices are expected to rise sharply by January in the wake of dwindling supplies and smaller livestock herds.

The number of cattle in the U.S. has been dropping for years, but the pace picked up last year when ranchers in Texas, the nation's top beef producer, sold a massive number of animals amid a severe drought in the Southwest. Farmers in Nebraska, Montana, Wyoming and the Dakotas bought some of those cows, however, so nationwide, the loss wasn't as great as it could have been. This year, virtually no one is expanding herds.

"The drought was really bad in the Southern Plains last year, but the cattle industry was able nationally to absorb it because it wasn't bad everywhere. This one is much more along the lines of bad everywhere, so the market implications are a lot larger and a lot more players in the industry are impacted by this," said Glynn Tonsor, an agriculture economics professor at Kansas State University.

The U.S. Department of Agriculture reported Friday that the nation's cattle inventory was the smallest since the agency began a July count in 1973. It estimates the size of the nation's herd each January and July. The U.S. had 97.8 million head as of July 1, 2 percent less than a year ago.

It is likely to take the beef industry years to recover. Cows have a nine-month gestation period, and it can take up to two years after calves are born for them to grow big enough for slaughter. The time needed to repair drought-damaged pastures will only extend that timetable because ranchers must have grass for grazing before they can add animals.

Grecian, 62, who farms northwest of Hays, said a local drought forced him to sell nearly 30 percent of his cattle in 2003. It took six years for him to rebuild once the drought ended. He did it by holding onto female calves and not selling them.

It's possible, he said, to rebuild faster by buying animals, but that can be costly when few young, female cows are available, and farmers might not get the animals they want.

"It is our life and we invest a lot of emotion and energy and money into developing a cow herd that is genetically what we want," Grecian said. "When we are forced to liquidate, it is not an easy thing to do. It is pretty heart-wrenching sometimes, but is part of the business."

Cattle have been streaming into auction yards across the country in recent weeks as grazing land burns up in the sun, ponds and streams evaporate and prices for feed corn rise. In Oklahoma City, the number of cattle going to auction quadrupled in one week earlier this month, and in Kearney, Neb., it increased three-fold.

In Texas, some 36,000 cattle were brought to auctions last week ? nearly triple the 13,400 animals sold just a couple of weeks earlier and approaching the 43,600 head sold at the same time during last summer's brutal drought, according to the USDA.

Calf prices are falling with so many animals on the market. A 600-pound calf now fetches $120 less than it brought in just a couple of months ago. Prices for feeder cattle, which are typically fed grass before going to feedlots to be fattened on corn, have collapsed as corn prices have gone up. Feedlots are spending about $200 more per cow on corn than they were just months ago.

Beef prices were already falling after rising 10 percent last year amid the drought in the Southwest. They peaked at an average of $5.09 per pound in January, and then came down to about $4.93 per pound in June. They are expected to increase again, but it's not clear by how much. The USDA had predicted a 2.5 to 3.5 percent increase in beef prices for the year, but that was before the drought spread and cattle selloffs mounted.

Jon Ferguson, 63, has weaned calves earlier and sold some cows about a month earlier than usual to save pasture on his ranch near Kensington, Kan. He has about 450 pairs of cows and calves and nearly 1,200 other calves that he buys each year to fatten on grass before shipping them to a feedlot.

He shipped a third of his cattle from Kansas to Colorado to graze during a drought in the summer of 1989. He's not sure whether that option will be available this year, or whether he should just liquidate and cut his costs now.

"If you can figure out a way to hang on to them at a reasonable cost until the drought is over, it typically pays you pretty well," Ferguson said. But, he added, "If this thing persists through the summer, and we see these kinds of temperatures with no significant moisture relief, we will be in trouble by fall."

There are many benefits of hiring professional Roofing Company in Portland. Professional roofing companies have experts to deal with roof restoration and other roofing issues. They have the skill, knowledge and ability to deliver good quality roofs. By hiring a professional roofing company, their experts are trained to handle the entire project. They work in hand with the clients' requirements and are capable of doing all work related to roofing. They can plan the design and layout and will ensure a properly completed job. Professional roofing companies are capable of handling any roofing jobs, however big or small they may be. A good roof can add value and beauty to your homes other than just shelter. A good roof will definitely increase your home's value. A roofing company in Portland will ensure that the roof of your home stays secure and will not leak for many years.

Most professional roofing companies offer guarantees for their roof installations. A good roof can make your home very energy efficient. A professional roofing contractor can install solar panels on the roof thereby reducing the electricity consumption. You can improve the indoor lighting and stabilize temperatures with roof ventilators and other roof accessories. A new roof is a big investment whether it is for commercial or residential purposes. In order to get quality roof at a good price, you have to be careful in choosing your roofing company in Portland. Make sure to do your research before you make a choice.

Ask for the roofing company's business license. Find out if they have a company insurance policy. Ensure that the company is financially stable. You can ask for the contractor's license and for references from previous clients. The first thing you must do is check the roofing contractor's license. However, a license does not provide proof for the quality of his work. For that, you must check and see if he is part of any associations and ask the association for the qualifications of the contractor. You could also ask other people who might have hired his services. You must also find out if the contractor has insurance coverage. It is not enough to know that they do have insurance coverage, it is important to know how much it is. As accidents occur frequently in the roofing business, you must protect yourself from a lawsuit by ensuring that the contractor has a worker's compensation insurance. All contractors must have a safety plan, so ask your contractor for theirs. Also find out how long is the period of warranty he offers on his work. Generally, it is one year or more. It is also a safe option to hire a roofing contractor for a small job to test his workmanship before you employ him for the more important task.

If you are buying or selling your home and have any concerns about roofing repairs or the condition of the roof you are thinking of purchasing ask a roofing contractor to give you a qualified third-party opinion.

It's irresponsible to think you can do your roofing assessment or tasks yourself, you could actually cause more damage than repair if you attempt to perform tasks without the necessary tools or knowledge. You should interview and negotiate with your chosen service to find out if they're right for the job, this way you'll be able to find the most suitable candidates for your Portland roofing needs. Educating yourself on these factors and what makes a good roofing Portland company will allow you to find the most reputable, professional and experienced roofing service in Portland.

Apple wins EUwide injunction against Galaxy Tab 77

Word around the mulberry bush is that Apple has just won itself a Europe-wide injunction against the sale of the Samsung Galaxy Tab 7.7, in case anyone still wanted to buy that tablet now that the Nexus 7 is out. The decision was taken in-between beer courses at the appeals court in Dusseldorf, but it didn't all go Apple's way -- Cupertino's request to have the re-designed Galaxy Tab 10.1 banned too was rejected, having already been turned down at preliminary hearing back in February.

The Tab 7.7 apparently infringes Apple patents that date from 2004 and, such is the power of one little German town, cannot technically be sold anywhere in the EU. In contrast, the failed claim against the 10-inch slate hinged on a "generic design patent," which a British judge has also vehemently dismissed. Glossing over the 7.7 decision, Samsung says it "welcomes the court's ruling" with regard to the 10.1N and accuses Apple of using "legal claims" to restrict "design innovation and progress in the industry."

Public hearing set on proposed NY sugary drink ban

(AP Photo/Richard Drew, File)

NEW YORK (AP) ? Doctors lined up at a public hearing to speak in favor of a proposed ban on large sugary drinks in New York, saying sodas and other sweetened beverages are a leading factor in the nation's fat problem. Critics see the plan as an assault on personal freedom.

New York City's health board was hearing testimony Tuesday on a proposal to combat a deadly obesity epidemic by banning restaurants, movie theaters and other eateries from serving giant-sized sugary drinks.

The panel is considering a rule that would limit soft-drink cup and bottle sizes at food service establishments to no larger than 16 ounces.

One doctor said before the hearing that the calorie-packed beverages consumers now down with abandon increase the risk of diabetes, and are responsible for a big share of the "massive suffering and premature death" linked to obesity.

"Soda in large amounts is metabolically toxic," said Walter Willett, a professor of epidemiology and nutrition at Harvard School of Public Health. "It's obvious that this is the right thing to do."

City Councilman Daniel Halloran III called the proposal a "feel-good placebo" that would hurt profit margins at small businesses, while failing to improve anyone's health.

He questioned whether a limit on the size of steak was around the corner.

Another critical councilman, Oliver Koppell, called the ban "a clear overreaching of government into people's everyday lives."

"This infringement on the rights of New Yorkers leads us to ask what will be banned next?"

The proposal requires only the approval of the Board of Health ? appointed by Mayor Michael Bloomberg ? to take effect. But opponents could still sue to block the ban, or they could convince legislators to step in and block the proposal.

The board is scheduled to vote on the measure Sept. 13.

Since Bloomberg proposed the ban in May, opponents including members of the restaurant and soft drink industries as well as libertarians have accused him of attempting to institute a "nanny state" with far-reaching government controls that infringe on individual choice. City officials, meanwhile, argue they are trying to save lives in the face of an epidemic that is killing New Yorkers and costing $4 billion a year.

The portion size restrictions would only apply to food-service businesses regulated by the Health Department, including restaurants, food carts, sports arenas and movie theaters. Grocery stores, drug stores and some convenience stores are regulated by the state and would be unaffected.

Drinks that are more than half milk or 70 percent juice would be exempt, and it wouldn't apply to lower-calorie drinks like water or diet soda, or to alcoholic beverages.

In a letter released Monday by The New England Journal of Medicine, New York University researchers said the ban could affect nearly two-thirds of drinks bought at the city's fast-food restaurants, according to a survey of more than 1,600 receipts. On average, sugary-drink buyers could consume 74 calories less per fast-food outing, the letter said.
