Germany, France draw battle lines over common bonds

BERLIN/PARIS (Reuters) - Germany dismissed a French-led call for euro zone governments to issue common bonds, a day before a European Union summit which investors are looking to for new measures to counter the bloc's debt crisis.

After a torrid week, stock markets rallied on optimism that the Wednesday summit would produce measures to foster growth and ward off the threat of contagion should Greece exit the euro.

The FTSEurofirst 300 index of top European shares closed up 1.9 percent and Spanish and Italian borrowing costs fell, leaving scope for disappointment if the EU leaders underwhelm.

New French President Francois Hollande will push a proposal for mutualising European debt at the informal summit, a scheme which many economists and policymakers say could be one of the most effective ways of restoring market confidence. Hollande has also called for a focus on growth rather than austerity.

But there is no sign that Germany, the EU's paymaster, led by Chancellor Angela Merkel, is ready to soften its opposition. Berlin says more progress is needed first on coordinating fiscal policies, a stance in which it has the backing of the Netherlands, Finland and Austria among others.

"Tomorrow's meeting will not deliver any landmark solution. The market is likely to be more prone to disappointment," said Matteo Regesta, a strategist at BNP Paribas.

A senior German official reiterated that Berlin did not believe jointly issued euro zone bonds were the solution and would not change its view, at least in the near term: "That's a firm conviction which will not change in June," the official said at a briefing. A second summit will be held in late June.

European economic commissioner Olli Rehn said the euro zone needed a roadmap spelling out specific integration steps that would eventually lead to joint debt issuance.

"We need to reflect what kind of European Union would be required to deepen economic and political integration, for instance, so that joint issuance of debt would make sense for all member states sharing the common currency," Rehn said in a speech to the European Parliament.

If euro zone nations ever manage to meet new fiscal rules demanding budget deficits of no more than three percent of GDP, then opposition to mutual debt issuance might melt away since national borrowing costs would presumably have converged too.

"In the very long term it may be a final chapter of a successful integration. That has always been the Dutch standpoint but it is not a solution to this crisis," Dutch Finance Minister Jan Kees de Jager said on television.

GROWTH MEASURES

The German official, speaking anonymously, also said he saw no need for leaders to discuss on Wednesday a loosening of deficit goals for struggling countries like Greece or Spain, or to explore new ways to recapitalize vulnerable banks.

With Greece holding an election on June 17, its second in as many months, which could hasten its departure from the euro zone if voters back anti-bailout parties, Merkel was put under some pressure at a weekend G8 summit in the United States. But she refused to budge on her insistence that any growth measures could not come via more deficit spending.

Without her agreement, no major policy shift will be possible.

The growth measures that are on the table - including boosting the paid-in capital of the European Investment Bank and plans for "project bonds" underwritten by the EU budget to finance infrastructure - will help. But most economists say they are nowhere near enough to turn the euro zone economy around.

The currency bloc appears to be heading back into recession having registered no growth in the first quarter.

Some major companies are feeling the pinch too.

British mobile phone operator Vodafone cut its medium-term sales target and took a writedown of 4 billion pounds ($6.3 billion) as cash-strapped customers in Spain, Italy, Greece and Portugal made fewer calls.

In its twice-yearly economic outlook, the Paris-based Organization for Economic Co-operation and Development forecast the 17-member euro zone economy would shrink 0.1 percent this year and said its debt crisis could still spiral out of control, with Greece struggling to remain solvent and Spanish banks needing to be recapitalized.

"The situation over the past few weeks has changed dramatically," OECD chief economist Pier Carlo Padoan told Reuters. "If the situation gets worse, there are ways to enhance the firewall capacity which could include a stronger intervention or role of the ECB."

MORE FROM ECB?

The OECD said the European Central Bank should not rule out buying government bonds again to keep borrowing costs down, lending directly to the ESM European bailout fund as well as cutting its main interest rate, which stands at 1.0 percent.

It could also consider another injection of liquidity into the banking system. The central bank's creation of more than 1 trillion euros ($1.3 trillion) of three-year money in December and February brought some temporary calm to the currency bloc.

As things stand, most of those options are opposed by at least some within the ECB governing council.

Speaking in London, International Monetary Fund chief Christine Lagarde said euro zone firewalls were a "work in progress".

Markets face an unsettling month before the Greek election and are also concerned about the shaky state of Spain's banking system and high debts. Madrid admitted on Friday its 2011 budget deficit was even higher than first thought.

Spain raised 2.5 billion euros in three- and six-month Treasury bills on Tuesday, the top end of the targeted range, at significantly higher yields than it paid investors for the same maturities a month earlier.

Greece, the cradle of the debt crisis, will recapitalize its four largest commercial banks to the tune of 18 billion euros, a senior banker said.

The funds, which will come from the euro zone's EFSF rescue fund, are needed to recapitalize Alpha Bank, National Bank of Greece, EFG Eurobank and Piraeus Bank, and will allow them to take liquidity funding from the ECB again, the banker said.

(AP) ? A former Boston University student who was ordered to pay $675,000 for illegally downloading and sharing 30 songs on the Internet says he will continue fighting the penalty, despite the Supreme Court's refusal Monday to hear his appeal.

Joel Tenenbaum, 28, of Providence, R.I., said he's hoping a federal judge will reduce the amount.

"I can't believe the system would uphold a six-figure damages amount for downloading 30 songs on a file-sharing system that everybody used," Tenenbaum said. "I can't believe the court would uphold something that ludicrous."

A jury in 2009 ordered Tenenbaum to pay $675,000, or $22,500 per song, after the Recording Industry Association of America sued him on behalf of four record labels, including Sony BMG Music Entertainment and Warner Brothers Records Inc. A federal judge called the penalty unconstitutionally excessive and reduced the award to $67,500, but the 1st U.S. Circuit Court of Appeals later reinstated it.

The 1st Circuit said a new judge assigned to the case could reduce the award again, but the record labels would then be entitled to a new trial.

Tenenbaum, who said he just graduated Sunday from the university with a doctorate in statistical physics, said he doesn't have the money to pay the judgment.

"I've been working on a graduate student's stipend for six years now and I have no such money," he said.

Tenenbaum argued that the U.S. Copyright Act is unconstitutional and that Congress did not intend the law to impose liability or damages when the copyright infringements amount to "consumer copying."

During the trial, Tenenbaum admitted he downloaded and shared hundreds of songs by Green Day, Nirvana, The Smashing Pumpkins and others. His lawyer suggested the damages should be as little as 99 cents per song, about the same amount Tenenbaum would have to pay for a legal online song purchase.

Lawyers for the recording industry argued that illegal downloading hurt the recording industry by reducing income and profits. A lawyer for the recording labels described Tenenbaum as a "hardcore" copyright infringer. The association said it offered to settle the case for $5,000 early on, but Tenenbaum declined.

"We're pleased with this decision," RIAA spokeswoman Cara Duckworth said after the Supreme Court's announcement Monday.

In the only other music-downloading case against an individual to go to trial, a judge last year reduced the penalty imposed on a Minnesota woman from $1.5 million to $54,000. An appeals court has scheduled arguments for next month in the case of Jammie Thomas-Rasset.

After last years great success with our first Zen & NVC retreat at Furnace Mountain we are happy to offer a slightly different theme this year, still diving into practicing both Zen and NVC.

Everyone is welcome at this training ? prior NVC knowledge and some experience with silent meditation is helpful but not an absolute requirement.
Together we will explore how the wisdom of Buddhist consciousness and the Buddha?s teachings about the non-existence of a fixed ?Self? go together with the practice of NVC and empathic self-connection and self-expression.

The workshop will include in introduction to the principles and basics of Zen practice and of Nonviolent Communication (NVC) as developed by Dr. Marshall Rosenberg.

Together we will explore silent meditation and will observe the never-ending inner dialogue, our ?monkey-mind?. In various and fun exercises we will explore ways to transform this inner dialogue from judgment, blame and analysis into a communication with ourselves that supports growth, aliveness and a compassionate and supportive connection with ourselves and the world around us.

Practices will include learning to:
? Sit upright with poise and grace in the middle of what is alive for you in the moment.
? Connect with what is alive for you in the moment.
? Listen to the inner dialogue and translate judgment, blame, criticism and analysis into a language that supports life
? Identify the positive motivation that underlies all self-blame, self-judgment and self-criticism.
? Shift patterns of thinking to transform depression, guilt, shame and fear.
? Distinguish between observations and evaluations, feelings and thoughts, needs and strategies, requests and demands.
? Attune to your own life-giving potential
? Express yourself honestly and openly

What is Zen?

The term ?Zen? derives from the Sanskrit term ?Dhyana? ? meaning dynamic stillness and meditation. To practice Zen is to give yourself wholeheartedly to what you are doing in each and every moment and to what is happening in each moment. While there are formal practices in Zen training such as sitting still and following the breath, the ultimate direction of Zen is to awaken to one?s life as it is and live it wholeheartedly. We practice to remember that this life is our only life and this activity is our whole life in the moment.

What is NVC?
NVC is both a concrete set of skills and a spiritual practice that leads to inner and outer harmony. The simple 4-step process supports emotional freedom, self-acceptance, inner peace, and fulfilling relationships. The practices include expressing ourselves honestly, listening with empathy, and developing inner compassion.
NVC was created by clinical psychologist and international peacemaker Dr. Marshall Rosenberg together with the global Center for Nonviolent Communication.

Facilitators:

Martha Lasley, certified NVC trainer,
Integrates Nonviolent Communication and transformational coaching to help people experience the alchemy of shifting blame and judgment into compassion and love. As a certified trainer for the Center of Nonviolent Communication she works with visionaries and social activists to unleash passion and create change. She designs and delivers coach training programs to ignite personal and organizational transformation. She teaches NVC around the world, in prisons, universities, NGO?s, corporations and homes. She is the author of two books, Courageous Visions and Facilitating with Heart.

Dae Gak, Zen Master,
Is the Founder, Abbot and Guiding Teacher of the Furnace Mountain Zen Retreat Center. He has practiced Zen for over 40 years and received Inka and Transmission over 15 years ago in the Su Dok Sah Korean Lineage from Zen Master Seung Sahn. He teaches in both the US and Europe. He holds a Ph.D. in Clinical Psychology and has practiced psychotherapy for 30 years. He is the author of the books Going Beyond Buddha, The Awakening Practice of Listening and Upright with Poise and Grace ? coming forward as you are. He has directed his life towards supporting people in their efforts to realize their original nature of fearless immediacy and unbounded compassion.

Daniela Myozen Herzog, Zen Teacher,
Has brought Zen meditation and NVC to teachers, day care providers, parents and children she has worked with. She is particularly interested in exploring and reconnecting with the wisdom of the body and raising awareness of what our body is communicating to us. She is a teacher in the lineage of Zen Master Dae Gak and leads Zen retreats both in Germany and the US. She works as a certified professional coach supporting people to create the change they want to be in their life.
